West Virginia’s First-Offense DUI Penalties

West Virginia law enforcement views a driver as being intoxicated if their blood alcohol content (BAC) is .08 percent or higher. For those driving a commercial vehicle, intoxication applies to a BAC of at least .04 percent. Drivers under the age of 21 can only have a BAC of .02 percent before law enforcement can charge them with a DUI.

If convicted, drivers should expect the following penalties from the first DUI:

  • Up to six months of jail time
  • Fines ranging from $100 to $500
  • A suspend driver’s license for 15 to 45 days
  • An ignition interlock device

For a BAC of .15 percent or higher, drivers will receive a minimum of two days in jail and a fine ranging from $200 to $1,000.

It is important to note that there is a 10-year look-back period for all DUI offenses. If you are charged with another DUI within 10 years of the first, the penalties increase significantly.
